Terms of Use

Draft — pending legal review. This page describes how Mutually works today. It isn’t final, and it isn’t yet a binding document.

This is a plain-language draft of what we expect from everyone who uses Mutually and what you can expect from us. It has not yet been reviewed by counsel and it is not yet a binding agreement. The reviewed terms will replace it, with a new version number, and members will be asked to accept them.

About these terms

These terms are an agreement between you and the company that runs Mutually (Mutually, 521 5th Avenue, 17th Floor, #9037, New York, NY 10175, USA). They apply when you use mutually.lol, the Mutually app, or a private link we send you. Our Privacy Policy explains how we handle your information, and our Community Standards explain how we expect everyone to behave; both form part of these terms.

Who can use Mutually

  • You must be 18 or over, and legally able to agree to these terms where you live.
  • Mutually is invite-only. An invitation is personal to the person it was sent to and can’t be passed on or sold.
  • You may have one account, and it must be about you. Don’t create an account for someone else.
  • You can’t use Mutually if we’ve previously removed your account, or if you’ve been convicted of a violent or sexual offence.
  • To be introduced, you shouldn’t be in a relationship that makes that inappropriate. If you’re already in a relationship, you’re welcome to help a friend as a Connector.

What Mutually is — and isn’t

  • Mutually suggests possible introductions. A person who knows you both decides whether to make one, and you decide whether to meet. We don’t promise any number of introductions, or any outcome.
  • Being vouched for isn’t a safety check. People who describe you speak to character. They carry no responsibility for anyone’s conduct.
  • We verify every member’s phone, email and photo, but we can’t vouch for how anyone will behave. Please read the Safety centre before you meet anyone, and use your own judgment.
  • Mutually isn’t a background-check or counselling service, and nothing on it is professional advice.

Your account

  • Keep your sign-in details and devices secure, and tell us straight away at support@mutually.lol if you think someone else has used your account.
  • Keep your contact details up to date so safety and account notices reach you.
  • You’re responsible for what happens on your account unless it was used without your permission and you told us promptly.

Your part

  • Be truthful about yourself — your name, age, photos, relationship status and intentions.
  • Treat everyone with respect, in the app and when you meet, and follow the Community Standards.
  • Keep what others share with you private. Don’t copy, screenshot, record or pass on anyone’s photos, words or details.
  • Don’t misuse Mutually: no commercial use, advertising, soliciting money, or recruiting; no attempts to search, scrape, browse or map the network; no bots, fake accounts or automated access; no attempts to get around a block, a pause or a removal; and nothing that breaks the law or harms Mutually’s systems.

Your circle and the people who describe you

  • When you invite people into your circle, you’re asking them to write about you. Only invite adults who know you and would be comfortable being asked, and only use contact details you’re allowed to share.
  • Each person who describes you decides who may see each of their answers. You can’t see anything they’ve kept private, and you won’t try to find out.

If you describe a friend (Connectors)

  • Only describe people you actually know, honestly and in good faith.
  • What you write is your opinion of someone’s character; you’re never asked to vouch for anyone’s safety.
  • If we ask you about a possible introduction, your answer is private. Please don’t tell either person that they were considered.

Your content

  • You own what you create on Mutually — your photos, words, voice notes and messages.
  • You give us a limited, worldwide, non-exclusive, royalty-free licence to host, store, process, adapt (for example, resize a photo or transcribe a voice note) and show your content, only as needed to run and improve Mutually as described in our Privacy Policy. The licence ends when your content is deleted, except for copies we must keep for safety or legal reasons.
  • You confirm you have the right to share what you upload, and that it doesn’t break anyone’s rights or these terms.
  • We may remove content that breaks these terms or the Community Standards.

AI features

Some parts of Mutually use AI — for example, the onboarding conversation, notes drafted from what you say, and suggested introductions. AI can get things wrong: check the notes drafted about you, and correct or delete anything that isn’t right. AI never makes an introduction or a decision for you.

Safety, reports and enforcement

  • You can block or report anyone from any conversation or introduction. A person reviews every report.
  • If someone breaks these terms or the Community Standards, we may remind them of the standards, pause their introductions, restrict features, or remove their account — and, where someone may be at risk, share information with the authorities.
  • When we act on your account, we’ll tell you what happened and why where we safely can, and you can appeal from the notice you receive.

Ending things

  • You can pause introductions or delete your account at any time from Settings. A deleted account can be restored for 30 days; after that it’s gone for good.
  • We may suspend or close an account that breaks these terms, puts others at risk, or where the law requires it. We may also end the service, with reasonable notice where we can.
  • Sections that by their nature should continue — such as your content licence for retained safety records, disclaimers and limits of liability — survive the end of these terms.

Cost

Mutually is free while we grow. If we introduce a paid membership, we’ll tell you clearly beforehand, and nothing will be charged without your agreement. We’ll never sell visibility.

Disclaimers

Mutually is provided “as is”. To the extent the law allows, we don’t make promises about the service beyond those in these terms — including that it will always be available, that anyone’s information is accurate, or that any introduction will go well. We aren’t responsible for how people behave, on Mutually or off it. Nothing in these terms limits rights you have under consumer law that can’t be excluded.

Limits of liability

To the extent the law allows, we aren’t liable for indirect or consequential losses, or for losses caused by other people’s conduct. Our total liability to you for any claim is limited to the greater of the amount you’ve paid us in the twelve months before the claim, or USD 100. Nothing in these terms limits liability for death or personal injury caused by negligence, for fraud, or for anything else that can’t be limited by law.

Disputes

If something goes wrong, please write to support@mutually.lol first — most things can be put right quickly. The law that governs these terms, and where disputes are decided, will be set out in the reviewed version. If you live in the EU or UK, you keep the protection of the mandatory laws of the country where you live, and can bring a claim in your local courts.

Changes to these terms

We’ll tell members in the app and by email before any meaningful change takes effect. If you don’t agree, you can delete your account before then. The version you accepted is kept with your account.
